Virtus Privacy Policy

Virtus HQ, Inc. ("Virtus," "we," "us," or "our") operates a mobile application and related services for athletes and coaches. The current version of Virtus allows athletes age 13 and older to create and maintain athletic profiles, share basketball-related information and game statistics, receive feedback, and communicate with coaches. Coaches may create profiles, manage or participate in team-related activities available in the app, provide feedback, and communicate with athletes.

This Privacy Policy explains the information we collect through the current version of the Virtus Services, how we use and disclose that information, and the choices available to users. It is intentionally limited to functionality available in the current MVP and does not describe planned enterprise, school-compliance, eligibility, payment, health-data, wearable, or other future functionality.

Virtus does not sell personal information and does not use personal information for behavioral or targeted advertising.

1. Scope

This Privacy Policy applies to the Virtus mobile application, the Virtus website to the extent it supports the current consumer application, and related support and communications (collectively, the "Services").

This Policy does not govern the independent privacy practices of third-party websites or services that may be linked from the Services. Those third parties operate under their own privacy policies and terms.

2. Who Uses Virtus

The current MVP is intended for:

  • Athletes age 13 and older who create athletic profiles and use the available athlete features.
  • Coaches who create coach profiles and use available coaching, feedback, roster, statistics, and communication features.

The current MVP is not intended for children under 13. Virtus does not knowingly permit a child under 13 to create an account. Any athlete profiles for children under 13 will be deleted.

3. Information We Collect

3.1 Information You Provide

Depending on how you use the Services, you may provide:

  • Account information, such as your name, email address, password or authentication credentials, date of birth or age, and account role.
  • Athlete profile information, such as school, team, position, jersey number, graduation year or class year, height or weight if provided, biography or athletic journey, game statistics, achievements, awards, and other basketball-related information.
  • Coach profile information, such as coaching role, team, experience, biography, and credentials or other information the coach chooses to provide.
  • User Content, including profile photographs, athletic photographs or videos, messages, comments, feedback, statistics, and other content submitted through the Services.
  • Support and safety information, including information included in support requests, safety reports, abuse reports, feedback, or other communications with Virtus.

3.2 Information From Other Users

Some information may be provided by another user. For example, a coach may add or submit team or game information concerning an athlete, or a user may submit content that includes another person. Users who provide information about another person are responsible for having appropriate authority or permission to do so.

3.3 Publicly Available Athletic Information

Virtus may obtain publicly available basketball information, such as player names, team or school affiliations, game statistics, results, or other athletic records, from public sources. Where Virtus obtains information from a third-party website or source, Virtus will use that information only where it is permitted to do so. Public availability does not eliminate applicable contractual, privacy, or other legal restrictions.

Virtus may associate permitted public athletic information with a user profile. If you believe public information associated with your profile is inaccurate or should not appear on Virtus, contact us using the information in Section 18.

3.4 Coach Background Check Status

Virtus uses Yardstik, a third-party provider, for coach background screening. Coaches provide the information required for a background check directly to Yardstik. Virtus does not receive or store the underlying background report, Social Security number, government identification document, or other sensitive screening information submitted to Yardstik.

Virtus receives only the limited status or result information needed for the coach-approval process, such as whether the screening is complete and whether the result satisfies Virtus's applicable approval criteria. Yardstik's collection and processing of screening information is governed by Yardstik's own notices, authorizations, and privacy practices.

3.5 Sign-In and Authentication Information

If the Services permit sign-in through Apple, Google, or another authentication provider, Virtus may receive information such as your name, email address, and an identifier associated with that provider. Virtus does not receive your password for the third-party service.

3.6 Information Collected Automatically

When you use the Services, we may automatically collect information needed to operate, secure, diagnose, and improve the app, including:

  • IP address and approximate location derived from IP address.
  • Device type, operating system, app version, browser or language settings.
  • Usage information, such as screens viewed, features used, timestamps, and interactions with the Services.
  • Crash, error, diagnostic, authentication, and security logs.

The current MVP does not collect precise location unless a current app feature expressly requests it and you grant device permission.

4. Information the Current MVP Does Not Collect

The current MVP is not designed to collect or maintain:

  • medical records, injury information, medical clearance information, allergy information, or other health records;
  • information from fitness trackers, wearable devices, or connected health devices;
  • biometric identifiers used to identify a person, such as facial-recognition templates, fingerprints, or voiceprints;
  • payment-card information or consumer subscription billing information;
  • school-administered education records or enterprise eligibility and compliance records; or
  • Social Security numbers, government-issued identification documents, or full background reports submitted for coach screening.

Users should not submit medical records, Social Security numbers, payment-card numbers, or other highly sensitive information through profile fields, messages, uploads, or support channels unless Virtus expressly provides a feature designed for that information.

5. How We Use Information

We use information collected through the current MVP to:

  • create, authenticate, maintain, and secure accounts;
  • create and display athlete and coach profiles;
  • provide team, roster, statistics, feedback, content-sharing, and communication functionality available in the app;
  • associate permitted public athletic information with profiles;
  • perform and administer coach verification and approval using limited results received from Yardstik;
  • moderate content and communications and protect athletes and other users;
  • respond to support, privacy, safety, and account requests;
  • detect fraud, impersonation, abuse, unauthorized access, and violations of our Terms or Community Guidelines;
  • diagnose errors, maintain the Services, and understand how the Services are used; and
  • comply with law, enforce our agreements, and protect the rights and safety of users, Virtus, and others.

We do not use personal information for behavioral or targeted advertising.

6. Messaging, Feedback, and Safety Moderation

Virtus includes communication and feedback features. Communications made through Virtus may be processed by Virtus and its safety providers for moderation, security, and enforcement purposes. Users should not treat messages sent through Virtus as private from Virtus's safety systems.

Virtus uses Tuteliq, a third-party safety and content-moderation provider, to assist with automated review of content and communications for potential safety concerns and violations of our rules, including grooming or predatory behavior, sexual content involving minors, harassment, bullying, threats, scams, and other harmful conduct.

Automated moderation may identify content for review or action. Virtus may review reported or flagged content when necessary to investigate safety issues, enforce our Terms or Community Guidelines, respond to reports, or protect users.

Virtus may remove content, restrict functionality, suspend or terminate accounts, preserve evidence, or make reports to law enforcement, child-protection authorities, or the National Center for Missing & Exploited Children when required or appropriate under applicable law and the circumstances. 7. Coach Verification

Coach verification is intended to reduce risk but does not guarantee that any coach or other user is safe, trustworthy, or suitable for a particular role.

Yardstik performs coach background screening as an independent third-party screening provider. Virtus does not store the sensitive information used by Yardstik to conduct the check. Virtus uses the limited status or result it receives to administer coach access and approval on the platform.

Questions or disputes concerning the contents or accuracy of a background report should be directed to Yardstik through the process identified in Yardstik's screening notices. Virtus will update its platform status when appropriate based on corrected information received through the screening process. 8. How We Disclose Information

Virtus does not sell personal information. We may disclose information in the following circumstances:

8.1 Other Users

Information you choose to include in a profile, roster, team context, message, feedback submission, or other shared feature may be visible to other users according to the functionality and settings of the Services. Users who receive information may be able to screenshot, copy, or re-share it outside Virtus, which Virtus cannot fully control.

8.2 Service Providers

We may provide information to vendors that perform services on our behalf, limited to the information reasonably necessary for those services. Current service categories may include:

  • application database, authentication, and backend services, including Supabase;
  • cloud hosting, storage, and infrastructure, including Amazon Web Services;
  • coach background screening, including Yardstik;
  • content moderation and safety technology, including Tuteliq; and
  • communications, crash reporting, security, or diagnostic providers used to operate the Services.

Service providers are expected to process information for the services they provide to Virtus and subject to applicable contractual and legal restrictions.

8.3 Legal and Safety Disclosures

We may disclose information if we reasonably believe disclosure is necessary to comply with law or valid legal process; investigate or prevent fraud, security incidents, abuse, or violations of our rules; protect the rights or safety of a user, Virtus, or another person; or make a legally required child-safety report.

8.4 With Your Direction or Consent

We may disclose information when you direct us to do so or otherwise provide consent.

9. Users Ages 13 to 17

Virtus's current MVP is intended for users age 13 and older. Virtus does not knowingly allow children under 13 to create accounts.

Because some Virtus users are teenagers, we use additional safety measures for interactions involving minors, including content and messaging moderation and restrictions or enforcement designed to reduce inappropriate adult-minor interactions.

Depending on applicable law and the functionality of the Services, additional consent, notice, or account restrictions may apply to users under 18. Virtus may request age or other information reasonably necessary to apply those requirements.

If we learn that a child under 13 has created an account or provided personal information directly through the Services without an applicable lawful basis, we will take reasonable steps to remove the account and information. A parent or guardian who believes a child under 13 has provided information to Virtus should contact privacy@virtus-hq.com.

10. Public Profiles and User Content

Athlete and coach profile information is used to provide the profile and community functionality of the Services. The visibility of particular information depends on the current features and settings made available by Virtus.

Do not upload content about another person unless you have the right or appropriate permission to do so. This is especially important for photographs, videos, contact information, and information concerning minors.

Virtus may remove content when required by law or when we reasonably believe it violates our Terms of Service, Community Guidelines, or safety rules.

11. Cookies, Device Data, and Analytics

Virtus may use cookies, local storage, device identifiers, software development kits, and similar technologies that are necessary for authentication, security, app functionality, diagnostics, crash reporting, and basic product analytics.

The current MVP does not use personal information for cross-context behavioral advertising or targeted advertising.

You can control certain permissions and technologies through your device or browser settings. Disabling a technology that is necessary for a feature may prevent that feature from working.

12. Data Retention

Virtus retains personal information for as long as reasonably necessary to provide and secure the Services, maintain an active account, respond to support or safety matters, comply with legal obligations, resolve disputes, and enforce agreements.

When an account is deleted, Virtus will delete or de-identify personal information within a reasonable period, subject to information that must or may be retained for legal, security, fraud-prevention, safety, dispute-resolution, backup, or enforcement purposes.

Backup copies may remain for a limited period until they are overwritten through ordinary backup cycles. Information that has been de-identified so that it no longer reasonably identifies a person may be retained and used for legitimate business purposes.

Virtus may retain limited records relating to serious safety or enforcement actions where reasonably necessary to prevent circumvention, protect minors or other users, comply with law, or establish or defend legal claims.

13. Security

Virtus uses administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, loss, misuse, or alteration. Safeguards may include encrypted transmission, access controls, authentication controls, logging, backups, and security practices provided through our infrastructure vendors.

No method of electronic transmission or storage is completely secure, and Virtus cannot guarantee absolute security. Users are responsible for protecting their account credentials and should notify Virtus promptly if they suspect unauthorized access.

14. Your Choices and Privacy Requests

You may be able to review or update certain profile and account information directly in the Services. You may also contact Virtus to request access to, correction of, or deletion of personal information associated with your account.

Depending on where you live, applicable law may provide additional privacy rights. Virtus will process valid requests as required by applicable law. We may need to verify your identity before completing a request.

To submit a privacy request, email privacy@virtus-hq.com. To request account deletion, use the in-app deletion feature or contact support@virtus-hq.com or privacy@virtus-hq.com.

Some information may not be deleted immediately or may be retained where permitted or required for security, fraud prevention, safety, legal compliance, dispute resolution, or enforcement.

15. Third-Party Services and Links

The Services may use or link to third-party services. Those third parties may collect information directly from you and process it under their own privacy notices and terms. Virtus is not responsible for the independent privacy practices of third parties.

In particular, information submitted directly to Yardstik for background screening is handled under Yardstik's screening disclosures and privacy practices.

16. United States Service

Virtus is based in the United States, and the current Services are directed to users in the United States. Information may be processed and stored in the United States by Virtus and its service providers.

17. Changes to This Privacy Policy

We may update this Privacy Policy as the Services change. When we do, we will update the "Last updated" date. If a change is material, we may provide additional notice through the Services, by email, or as otherwise required by law.

This Policy describes the current MVP. If Virtus later introduces materially different functionality - such as payments, enterprise school services, eligibility or compliance workflows, health or wearable data, biometric processing, or other new categories of data - Virtus will evaluate and update its privacy disclosures before or in connection with launching those features.
