These Terms of Service ("Terms") are a legal agreement between you and Virtus HQ, Inc. ("Virtus," "we," "our," or "us") governing your access to and use of the Virtus mobile application, website, and related services (collectively, the "Services"). By creating an account or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. About Virtus
Virtus is a basketball platform that allows athletes age 13 and older and coaches to create profiles, share basketball-related information, communicate through the platform, and participate in a trusted athletic community. The current MVP supports athlete profiles, coach profiles, basketball statistics, athlete feedback, messaging, and related features available within the application.
2. Eligibility
You must be at least 13 years old to create an account. You must provide accurate registration information, may not impersonate another person, and may not use Virtus if your account has previously been suspended for violating these Terms. Coach accounts may require successful completion of third-party verification.
3. Your Account
You are responsible for maintaining accurate account information, protecting your login credentials, and all activity that occurs under your account. Notify Virtus immediately if you believe your account has been compromised. Virtus may suspend or terminate accounts created with false information or used in violation of these Terms.
4. Coach Accounts
Coaches may create profiles, communicate with athletes through available messaging features, provide athlete feedback, and use available team functionality. Certain coach features may require successful verification through Yardstik. Background screening reduces risk but does not guarantee that any individual is safe or suitable.
5. Acceptable Use
Users may not impersonate others, submit false athletic information, harass or threaten others, exploit minors, upload unlawful or sexually explicit content, interfere with the Services, scrape Virtus data, or violate applicable law.
6. User Content
You retain ownership of content you submit. You grant Virtus a limited, non-exclusive license to host, store, display, and transmit your content solely to operate and improve the Services. You represent that you have the rights necessary to upload your content.
7. Messaging and Community Safety
Virtus provides messaging tools to facilitate sports-related communication. Virtus uses Tuteliq to assist with automated moderation of content for safety purposes. Virtus may review, remove, or restrict content that violates these Terms or the Community Guidelines.
8. Coach Verification
Coach verification is performed by Yardstik. Sensitive screening information is submitted directly to Yardstik. Virtus generally receives only limited verification status information necessary to administer coach approval. We do not receive or store any personal information in the review and adjudication of background checks.
9. Suspension and Termination
Virtus may suspend or terminate accounts that violate these Terms, submit fraudulent information, present safety risks, or fail required verification. Virtus may remove content without prior notice where appropriate to protect users or comply with law.
10. Contact
We may update these Terms. We'll post the new version with an updated date and, for material changes, give at least 30 days' advance notice by email or in-app notice. Changes aren't retroactive.
